The effects of insolvency proceedings regularly affect not only the debtor himself, but also his family, which is often financially dependent on him. This applies in particular to his minor children, who are unable to support themselves. Within the insolvency proceedings, family and social interests collide with insolvency law regulations that ostensibly serve the equal treatment of creditors. The author aims to counter the resulting tension. To this end, she comprehensively examines the protection of the family in insolvency. The author examines the question of the extent to which the opening of proceedings affects the economic livelihood of the family and the debtor's marriage and the extent to which the legislature has addressed this issue in the context of the introduction of the Insolvency Code in 1999 and in subsequent legislative reforms. She also examines the extent to which debtors have the opportunity to secure their relatives in the run-up to insolvency by means of asset protection. The author focuses on the question of whether there is a need for more pronounced protection of the family in insolvency proceedings through the safeguarding of maintenance claims. To this end, the impact of insolvency proceedings on maintenance claims that have already been satisfied, on arrears and on current maintenance claims is comprehensively examined, and whether the existing protection in this respect does justice to the importance of the maintenance claim for securing the livelihood of the maintenance creditor.
