Product details

International law increasingly determines the living conditions in a globalized world. The author aims to uncover the legal dogmatic aspects of the relationship between international law and domestic law. Solutions proposed by international legal doctrines are presented, along with their implications.

At the center of the investigation is the question of whether international law and domestic law represent a unified legal order—known as monism—or whether they are separate legal spheres—known as dualism. To understand these doctrines, the author first engages with the historical development of international relations and the question of international law as the legal order of the community of states. Building on these foundations, the presentation of dualistic and monistic doctrines forms the substantive focus of the work. Finally, the question of the incorporation of international legal norms into German law is addressed. It is noted that the opposition between monism and dualism continues to exist within international legal doctrines and state practice. However, the monistic and dualistic concepts have approached each other and have only been able to assert themselves in their respective moderate forms, even though they continue to hold different positions in their fundamental statements.
