On 12 December 2017, the European legislator adopted a regulation to revamp the European securitisation market (Regulation (EU) 2017/2402). This regulation is intended to restore the confidence of market players in securitisations that has been lost since the financial crisis by establishing both a uniform regulatory framework for securitisations and a quality segment for so-called simple, transparent and standardised securitisations in Europe. David Anschütz examines whether the regulatory concepts succeed in reviving the securitisation market while maintaining sufficient investor protection. Besides a systematic classification and presentation of the regulations, he focuses on the new transparency regime, STS securitisation and the regulatory move away from rating agencies in the new European securitisation law.
