Product details

In civil proceedings, the parties are often not only concerned with the court's decision on the individual case. They also hope for a binding guideline for the future from the judgment. To this end, a global application is made the subject of injunction and declaratory actions. The courts are asked for comprehensive legal advice in this way. However, the boundaries of what is permissible in this context have not yet been sufficiently clarified in academia and practice. The author examines the area of legal protection provided by injunction and declaratory actions in civil proceedings, using the example of the global application in labor court proceedings. Following a critical analysis of the case law on the subject, alternative approaches are proposed to satisfy the parties' desire for legal certainty beyond the specific dispute.
