About the Work

When importing and exporting goods and services, as well as transferring know-how, especially in relation to non-EU partners, businesses and research institutions must adhere to a multitude of legal restrictions. The interplay of the Foreign Trade Act and the Foreign Trade Regulation with EU law (particularly the Dual-Use Regulation), international agreements (such as the Chemical Weapons Convention), and current prohibition lists results in complex rules, the violation of which can lead to severe penalties. This new commentary untangles the regulatory jungle. It explains legal sources and reasons for possible import and export restrictions, outlines the procedural steps to be followed, and clarifies numerous questions that arise in practice on a daily basis. The work also currently takes into account the 7th Regulation amending the Foreign Trade Regulation.
