About the Act: The ProdSG implemented the European Product Safety Directive 2001/95/EC into German law. The law serves as the enabling basis and fundamental regulation for all ordinances based on the ProdSG, which in turn implement European CE directives. The ProdSG is also aligned with the New Legislative Framework in European law, particularly with the European Market Surveillance Regulation No. 765/2008, which regulates essential core concepts and regulatory requirements for market surveillance authorities. The ProdSG serves several objectives: the realization of the EU free movement of goods through harmonized legal regulations for manufacturers, quasi-manufacturers, EU importers, and traders, the protection of the CE marking as a uniform conformity marking in the EU internal market, and consumer protection through safety.
