About the Work

The commentary addresses the challenging legal institution of state liability for wrongful acts. Since this area of law is only imperfectly regulated by legislation, the doctrinal examination of the foundations of state liability claims and their development through case law is of particular importance. In this regard, the commentary includes the EU law-based state liability claims, state liability claims under regional law in the new federal states, the basic principles of police and regulatory authority liability, liability for breaches of administrative legal relationships, compensation claims due to expropriation-like interventions and based on principles of sacrifice, as well as legal protection in cases of excessively long court proceedings and criminal investigations. The liability of court-appointed experts is also addressed.
