In the case of business transfers, works councils face a variety of tasks. On one hand, the focus is on the requirements for the application of Section 613a of the German Civil Code (BGB), and on the other hand, the central issue is the potential impact that the transfer of businesses or parts of businesses to another company can have. Despite the important protective provisions in Section 613a BGB, affected employees may face numerous disadvantages.
