The starting point of the work is the decision of the Federal Constitutional Court regarding the permissibility of online searches from February 27, 2008. This ruling not only clarified the question of the legality of this investigative measure but also established a new fundamental right: the right to guarantee the confidentiality and integrity of information technology systems. Based on the ruling, the necessary technical terms are first explained in an easily understandable manner. Furthermore, the new fundamental right is presented in detail, along with its potential implications for statutory law, such as enabling online searches by the Federal Criminal Police Office or the possible civil law protection of data collections resulting from the ruling. The new fundamental right is then placed in the context of European and international law.
