Particularly in crisis situations, location security agreements are a suitable means to improve the competitiveness of companies and secure jobs. A common phenomenon is that such agreements are concluded between three parties, namely the employer, the union, and the works council. In this context, the parties are usually unaware that by entering into a joint contract, they may jeopardize the effectiveness of the agreement. German labor law essentially recognizes only collective agreements and works agreements as forms for collective legal norms contracts. This paper examines the doctrinal classification of such three-party agreements and provides guidance on how to handle them in practice.
