The approach of companies to internationalizing their business activities is diverse. Since the freedom of establishment for companies encounters legal boundaries, as it does not find a uniform legal basis due to different legal systems, it is necessary to clarify to what extent the presence and/or business activities of foreign companies affect the liability, legal capacity, and business competence of these companies, as well as which law is applicable. This book presents the law on establishment at the level of world trade and EU primary law, including its references to third countries, as well as EU secondary law. It also addresses possible alternatives for corporate structuring beyond the intense discussion about the choice of legal form. This text reflects the legal status as of February 1, 2012.
