Legal views and results must be substantiated. This also applies to the generally held thesis that the right of the conditional buyer does not expire with the seller's option to withdraw, but only with the exercise of the withdrawal. There is no substantive engagement with this position in either case law or literature. This paper aims to stimulate legal discourse. It clarifies the structure of the conditional buyer's right, demonstrates that the aforementioned thesis is incompatible with the prevailing definition of the right of condition, and develops a legal construction that allows the courts to methodically justify the quite reasonable outcome of the prevailing thesis.
