The work examines whether there is a continuation or revival of shared ownership in the 19th and 20th centuries. The author traces the German discussion surrounding shared ownership and notes that the doctrine of shared ownership has persisted in German legal teaching from Runde through Eichhorn, Mittermaier, Beseler, and Gierke to the BGB (German Civil Code). For the 20th century, the attempts of legal science and jurisprudence to revive shared ownership in connection with certain legal phenomena are analyzed. Fiduciary security rights and, in particular, residential leases play a central role in this context. The author's conclusion is that, even under the BGB, legal positions comparable to usufruct have developed.
