Christian Resch examines the development of Italian law on performance disturbances over the last two centuries and its current position among European legal systems. This is illustrated through claims for damages and performance as well as the right to contract termination, which are granted to the creditor in the event of the debtor's non-performance. The author analyzes each of these legal remedies in two sections. First, he presents the situation during the validity of the codice civile of the Kingdom of Italy from 1865, with particular attention to the preceding historical development. In a second section, he reviews the legal situation within the codice civile of 1942, which is still in effect today. A particular focus is placed on the historical development of the relevant norms. Ultimately, the author reaches a conclusion.
