With the significant increase in the cross-border dissemination of media, particularly the Internet, there has also been a sharp rise in cross-border violations of personality rights. However, the question of which law applies in these cases is still addressed inconsistently across Europe. In light of the resulting need for harmonization, the author provides a comprehensive overview of substantive and international personality rights, focusing on media-related issues, using the German, French, and English legal systems as examples. Based on this, a proposal for a European conflict-of-law rule is ultimately presented. As a consequence of the failed negotiations regarding the Rome II Regulation, the study takes into account not only legal practicalities but also societal and media policy interests.
