The new Federal Data Protection Law

With the adoption of the new Federal Data Protection Act through the Data Protection Adaptation and Implementation Act, new legislation comes into effect on May 25, 2018. Part III of the new BDSG implements Directive EU 2016/680 regarding the protection of natural persons in the processing of personal data by competent authorities for the purpose of preventing, investigating, detecting, or prosecuting criminal offenses or for the enforcement of penalties. New data protection rules for police, judiciary, prosecution, administrative offenses, and threat prevention will regulate the interplay of data protection law in the future. The introductory work explains the regulations based on the official justification, clarifies the connections to the provisions of Directive EU 2016/680 and its recitals, and provides insights into the interaction of the provisions with the general rules.
