The new law on the representation of severely disabled individuals is in effect. The new regulations are complex and intricate. The Federal Participation Act (BTHG), with its improvements for self-determined living, will be implemented in stages until 2020. The new rules for employers, employees, and their representatives have been prioritized. They have been in effect since December 30, 2016, in the first stage. The second stage begins on January 1, 2018. The handbook provides clarity. It offers all the necessary information for practice in companies and public offices: from the required inclusion agreement to the strengthening of the legal status of the representation of severely disabled individuals, personnel, and works councils. A key focus of the explanation is the new invalidity clause, which is particularly important for both employers and employees; terminations made without proper consultation of the representation of severely disabled individuals are invalid.
