Product details
This book addresses the question of the relationship between private and public enforcement of EU antitrust law. It particularly examines whether the current Union law provides any guidance on the nature of the relationship between these two forms of enforcement. The focus is on analyzing the primary legal framework of the antitrust damages directive 2014/104/EU. In this context, the Union legislator chose a solution to eliminate the tensions between public and private antitrust enforcement. The author argues that the directive is incompatible with the primary enforcement model and requires correction.
