In 2013, it was clarified in Section 22 (3) of the Personal Status Act (PStG) that the status of intersex individuals can be registered in the birth register without specifying a gender. Nevertheless, German family law continues to be based on a binary gender system. The presentation analyzes the question of whether a third gender should be recognized or if gender as a category of family law should be entirely disregarded.
