The focus of the work is a plastic representation of the applicable waste definition under EU law, along with the specific existing definition and demarcation issues. This is achieved through a detailed analysis of the individual elements of the waste concept. In particular, the question is explored whether and to what extent real estate can fall under waste law following the ECJ's decision in case C-1/03 (Van de Walle et al.). Furthermore, the work specifically addresses the criteria for disposal. These are illustrated by a list of disposal indicators and an overview of the most important decisions of the ECJ's case law. Following this, an assessment of the compliance of paragraphs 1 to 4 of the 3 KrW-/AbfG and the scope of the BBodSchG with EU law is conducted.
