Decisions regarding internal organizational conflicts have long held a firm place in administrative jurisdiction. However, despite their high practical relevance, one cannot speak of legal dogmatic clarity. There is considerable disagreement even about the subject matter of so-called internal legal disputes: some consider only the so-called organizational disputes, while others also include certain membership claims. Questions regarding the subject and concept of internal organizational legal protection and the scope of rights enforceable in court are addressed by jurisprudence and literature with varying, sometimes contradictory solutions. The author therefore takes the current discussion on internal organizational legal protection in the field of civil law, particularly corporate law, as an opportunity to discuss fundamental questions of internal legal disputes in public law.
