The Directive (EU) 2016/943 of the European Parliament and of the Council of June 8, 2016, on the protection of confidential know-how and confidential business information (trade secrets) against unlawful acquisition, as well as unlawful use and disclosure, has been implemented with the federal law amending the Federal Act against Unfair Competition 1984, the Code of Civil Procedure, and the Consumer Protection Cooperation Act. It came into force with a delay of almost ten months on January 29, 2019. The text of the law, along with attached materials, the directive, a bibliography, an introduction to the topic, and a legal comparison of the German draft law for the implementation of Directive (EU) 2016/943 on the protection of trade secrets against unlawful acquisition, as well as unlawful use and disclosure, are provided as the first working aid for interested parties.
