The balancing act is the core of land-use planning. The requirement for balancing according to the Building Code must be observed in the preparation, amendment, supplementation, or repeal of any land-use plan. The elements of the land-use planning balance have been firmly established since the landmark decision of the Federal Administrative Court on December 12, 1969 (4 C 105/66). Nevertheless, numerous questions remain open in detail. In particular, the application of EU law and national legislation on environmental law presents planners and legal practitioners with ongoing challenges. Guiding concepts, planning guidelines, and principles of planning aim to influence or steer both the process and the balancing decision in various ways. In doing so, statutory requirements from a multitude of legal fields must be taken into account.
