Jürgen Stamm takes the ongoing discussion about the legal nature of the notice of claim, which has lasted for over a century, as an opportunity to question this legal figure. The starting point of this monograph is an analysis of the convoluted history of the notice of claim's origin. The resulting fundamental contradictions in valuation make the notice of claim appear as a foreign body within the German Civil Code (BGB). Jürgen Stamm proposes equating the notice of claim with a conditional disposition. This way, the regulations regarding the notice of claim can be harmoniously integrated into the conceptual framework of the BGB. Existing contradictions regarding the separation and abstraction principles, the numerus clausus of property rights, the principle of publicity, general conditional theory, and the principle of priority can be resolved. At the same time, many of the disputes previously associated with the notice of claim can be traced back to familiar ways of thinking.
