Yun-Ju Wang presents the reception history of the German fundamental rights as a legal institution in Taiwan, whose legal system transitioned from the traditional Chinese perspective to the modern Western legal system. The author examines the extent to which the understanding of fundamental rights as a legal institution has been received, as long as the German understanding of fundamental rights played a significant role, and how the further realization of fundamental rights in Taiwan was enforced on the path to a constitutional state after World War II. Finally, she illustrates how the paradigm shift in the granting of fundamental rights from an authoritarian to a new, democratized, and liberalized state of the constitutional state has been theoretically and practically implemented in Taiwan since 1987.
