The error of prohibition has become practically insignificant in German criminal law, playing at most a theoretical role in university lecture halls. This is primarily due to the restrictive interpretation of the concept of avoidability, which is left to the snapshots of jurisprudence. The tendency to reduce the duty to inquire - as a factor of avoidability - to a negligible size is characteristic of a development in criminal law that places increasingly higher demands on the legal knowledge of those subject to the law. The author therefore calls for a redefinition of the criteria for avoidability, with the starting point being the distinction between inalienable subjective rights on one hand and legal goods on the other, so that the penal code can once again become the Magna Carta of the citizen.
