The occasion for this work was the ruling of the Federal Constitutional Court regarding secret paternity tests from February 13, 2007. The Constitutional Court approved the BGH's case law, stating that secret paternity tests are inadmissible. At the same time, it mandated the legislature to introduce a procedure that allows fathers to verify their biological paternity independently of the contestation process. This work analyzes the ruling of the Federal Constitutional Court as well as the newly introduced Section 1598a of the German Civil Code (BGB). Additionally, it explores the question of why knowledge of one's biological paternity is considered a factor in personal development. Based on the findings, perspectives for a new law on descent are presented.
