The right of insolvency avoidance as a means to increase the insolvency estate follows the trend of globalization, leading insolvency administrators to increasingly confront international issues. This work examines, through a comparative legal perspective and with special consideration of financing problems, the procedural and substantive legal requirements of an insolvency avoidance process under German and English law. Additionally, the impacts of the European Insolvency Regulation, the UNCITRAL Model Provisions, and the new regulations of German International Insolvency Law that came into effect in March 2003 are included in the investigation. Finally, after evaluating the reforms implemented in both legal systems, further improvements to the law of insolvency avoidance are suggested.
