Pascal Pfisterer presents the current state of regulatory frameworks for investor protection and subsequently conducts an analysis and evaluation of the new provisions of the Markets in Financial Instruments Directive (MiFID II). Particularly noteworthy are the new approach to Product Governance and the regulatory tool of product intervention. Of utmost interest are also the tightened regulations on investment advice, which will have far-reaching consequences for the distribution of financial instruments. In conclusion, the author assesses whether the regulations of MiFID II will lead to a higher level of investor protection.
