Transplantation medicine is still suffering from a significant shortage of organs. The number of patients on waiting lists who urgently need a donor organ far exceeds the number of available organs. The reasons for this long-standing situation are numerous. Among other things, the collaboration of the institutions involved in post-mortem organ transplants is repeatedly criticized. The cooperation model of "shared responsibility" established in Section 11, Paragraph 1, Sentence 1 of the Transplantation Act (TPG) is presented in detail regarding its fundamental structure and its effects on the legal position of the individual participants. The focus is on examining and delineating the competencies of both the transplant centers and hospitals, as well as the German Foundation for Organ Transplantation (DSO), which occupies a special organizational position in the process. Additionally, the liability implications of the system are considered before the author presents necessary proposals for improving collaboration in post-mortem organ transplantation.
