When granting subsidies, the awarding authorities regularly include a condition in the subsidy notifications that the recipient must comply with the regulations of procurement law when awarding supply, service, or construction contracts. This carries a significant risk of error. A (partial) reclaim of the subsidy can seriously jeopardize the financing of a project or even the existence of the recipient. This study examines whether and under what conditions the authority can reclaim a subsidy in the event of a violation of procurement law. It also explores whether the authority has discretion in this matter and whether this discretion is guided by administrative regulations. Furthermore, it investigates whether every violation of procurement law constitutes grounds for revocation or if it simultaneously also violates the principle of economic efficiency.
