Germany more than half a century after Hitler: Right-wing extremists are marching, Nazi symbols are being displayed, slogans are being chanted. Even more alarming are the outbreaks of violence and hatred directed against foreigners and other minorities. The activities of the Auschwitz deniers, who call themselves "revisionists," seem to fit seamlessly into this context. In this country, a response has been made with Section 130 (3) of the Criminal Code. The punishment for revisionist statements as insults is placed alongside the punishment for incitement to hatred. The author addresses the question of whether the criminalization of Auschwitz denial is compatible with fundamental principles of criminal and constitutional law. It is explained why the findings of established contemporary historical research are the appropriate standard for determining whether someone is denying something in the realm of history.
