The author examines the reasons for the ineffectiveness of foundation deeds and their legal consequences. The background is the increasing number of foundations: there are already more than 20,000 in Germany. The more foundations are established, the higher the likelihood of errors occurring. The consequences of such errors have hardly been addressed in the literature so far. This book aims to change that by addressing not only the reasons for ineffectiveness but also the resulting legal consequences for founders, potential co-founders, and the foundation itself. Taking into account the special effect of official recognition, the author demonstrates in which situations the continued existence of the foundation is possible despite an ineffective foundation deed.
