State protection, as the ability of the state to preserve and defend its own existence, is a fundamental expression of state sovereignty. Constitutional and state protection in a broader sense occurs preventively, repressively, and through regulations for states of emergency. Criminal state protection in a narrower sense falls within the repressive domain. The Federal Prosecutor General serves as the investigative authority of the federal government. This work examines the responsibilities of the Federal Prosecutor General in state protection criminal cases. It presents the historical foundations, the constitutional derivation and definition, the simple legal understanding of competence that can be developed from this, as well as the justiciability of state protection jurisdiction.
