This book raises the question of whether salary payments from employees during a company's crisis are contestable in the event of wage concessions. The rulings of various courts create the impression that if an employee agrees to defer salary payments to help the company out of its crisis, they risk having these earned wage claims reclaimed by the insolvency administrator upon payment. Whether German insolvency law truly allows this, what the highest court rulings indicate, and which strategies are promising to render a challenge by the insolvency administrator ineffective are discussed and presented in this book.
