Product details

Friedrich Carl von Savigny is regarded as the most significant German legal scholar. His noble background granted him access to the highest state offices, and his refined intellect brought him into close connection with the leading poets of his time. His doctrine of the Volksgeist as the origin of all law linked these two worlds: drawing from the ideas of Romanticism, he devised a program to overcome the old natural law and pave the way for a new legal order. However revolutionary his scholarship may have been, he was politically opposed to the advancements of his time. Both aspects continue to resonate today: Savigny’s scientific self-understanding still shapes legal theory, just as his skepticism towards political change does. This essay explores the tension between innovation and stagnation in Savigny’s life, work, and legacy.
