The authors take the widespread criticism of balancing pragmatism in fundamental rights jurisprudence as a starting point to develop a holistic theory of fundamental rights. Instead of value and principle pyramids, they propose a reflexive model that can make societal incommensurabilities legally commensurable. This implies a departure from the traditional vertical, epistemic, and semantic holism of fundamental rights and calls for addressing conflicts of fundamental rights within a framework of horizontal, practical, and pragmatic holistic concepts. The guiding question is: How can one address the problem of incompatibility in the collision of social logics without falling into the vertically holistic "thinking from the whole"?.
