The ZPO ensures that a legally binding judgment is applied in subsequent proceedings when the legal consequence determined in the prior process occurs. There is no general regulation in the ZPO for the case where a prejudicial legal relationship from the prior process is independently subject to decision in the subsequent process, and the judgment resulting from it contradicts the incidental decision of the prior process regarding the legal relationship. The resolution of the conflict, particularly the question of whether it can be resolved in a third proceeding, is the subject of this document. In the first part of the document, the author addresses fundamental questions regarding the temporal limits of legal force, namely factual preclusion, the extent of the second court's binding nature to the results obtained in the prior process, and the measure thereof.
