Among the legally regulated cases in which, despite the existence of a factual and unlawful behavior, no punishment is imposed, the exceeding of self-defense is certainly the most obscure. With this vivid formulation, Roxin aptly expresses what the engagement with literature and jurisprudence regarding Section 33 of the Criminal Code leaves as an impression: the norm is one of the least clarified and simultaneously one of the most controversial provisions of the General Part of the Criminal Code. To shed light on this darkness, the author develops a concept using the classical canon of interpretation that is suitable for providing a unified and coherent solution to the manifold manifestations of exceeding self-defense. Such a solution should particularly take into account the peculiarities of this atypical and perplexing norm and make it comprehensible. Central significance.
