According to the prevailing opinion, the commission of a crime as an accomplice is only possible with the intent of all involved parties. This is justified by the argument that the formulation of a common criminal intent is excluded in the case of individuals acting negligently or failing to act, as well as by the lack of differentiation among the various forms of participation in negligent offenses. Simone Kamm explores the question of whether and, if so, under what conditions negligent complicity can still be recognized. After a critical examination of the structure of intentional complicity, the treatment of negligent involvement by multiple parties in older and newer case law and scholarship is presented and evaluated. The author concludes that the arguments against negligent complicity and their alternative proposals for legal classification are insufficient.
