The central question is whether teachers have a legally protected space for their educational and teaching activities and how far this space extends, if at all. In the first part, the author defines the external framework of educational freedom: On one hand, teachers, due to their comprehensive legal obligations, are in no circumstances permitted to infringe upon the rights of the children and adolescents entrusted to them or those of third parties. On the other hand, there are numerous decisions in the field of education that are made based on a specific, subsequently unreconstructable situation, and therefore evade comprehensive judicial review.
