With the privatization of telecommunications according to Article 87f of the Basic Law, the state is tasked with transitioning the telecommunications service management into a privately structured competition. The state’s determination of competitive conditions is entrusted to the Regulatory Authority for Telecommunications and Post as outlined in Sections 66 ff. of the Telecommunications Act. The author examines the extent to which this authority is independent. To this end, he explores the organizational legal relationships of the authority with the regulated companies, the federal government, the states, and the European Community. From the perspective of functional independence, Klaus Oertel demonstrates that the state administration, in its role as regulator, must isolate itself from the state administration in its role as entrepreneur and majority owner of the largest regulated company.
