The treatment of spousal contributions in the context of the division of assets is a central point in family law discussions, where the question of the reversal of unnamed contributions through a claim based on the loss of the basis for the transaction has increasingly come to the forefront. Jeep counters this trend with a detailed analysis of the interplay between Sections 1380 and 1374 (2) of the German Civil Code (BGB) and calls for a return to the property law compensation. In this context, the distinction between unnamed contributions and genuine gifts is already established: it aligns with the differentiation between contributions that are to be credited and those that are not. The author demonstrates that Section 1380 applies solely to the former, while Section 1374 (2) applies solely to the latter. Through a systematic implementation of the crediting process, even excess contributions are taken into appropriate account.
