The concept of enemy criminal law, attributed to Günther Jakobs, has gained increasing relevance in recent years and has become almost indispensable in the debate surrounding the balancing of conflicting security and freedom interests within ongoing legislative processes, especially when it involves sensitive and media-effective areas such as anti-terror legislation or sexual criminal law. Geraldine Morguet first analyzes the concept of enemy criminal law by outlining the underlying theoretical model and its external characteristics. In a second step, the applicable criminal law is examined for common features, also using examples from criminal policy and jurisprudence. Not least, the subsequent comparison with foreign legislative developments (particularly in Colombia and the United Kingdom) demonstrates that criminal law is evolving.
