The experience of wrongdoing related to organizations has led to calls for penalties against associations and especially companies – going beyond the existing fine regulations of administrative offenses law and European law. The author examines whether such organizational punishment, following the international trend, can be justified. It proves impossible to provide a uniform justification for individual and collective punishment. It must either forgo subjective attribution and thus the principle of guilt for the entire criminal law, or it assumes a reflective capacity of the collective entity that is equally incompatible with individual freedom and responsibility. Additionally, linking to the actions of the organization's bodies or members does not ensure the unity of criminal law. It leads to circular attributions or becomes entangled in a contradiction.
