The significance of the partnership share as an independent legal object, as well as the permissibility of multiple participation, has so far been unclear in case law and literature. The author fills this gap by tracing the reification of the partner status as an independent asset and demonstrating the function of this objectivity. Based on this, the previously diffuse but practically relevant problem of multiple participation is resolved: while such participation is generally permissible even in partnerships, the acquisition of an additional partnership share by a co-partner necessitates an adjustment of the legal situation within the internal relationship of the partnership. Philipp Lamprecht addresses the resulting problems and distinctions in relation to case law and by comparing it with the legal situation.
