The jurisdiction of constitutional courts allows them to annul laws passed by the democratically legitimized legislator. This inherent systemic break requires a special level of personnel democratic legitimacy for the constitutional judges, as stipulated by the constitution itself. Against this backdrop, the selection practices and election procedures for candidates to fill the judges' bench of constitutional courts are examined. For the analysis, the nomination process for judges of the U.S. Supreme Court is also considered in a comparative manner. Constitutional judges' elections are provided by the constitution as an open political process that requires a vote in the plenary sessions of the Bundestag and Bundesrat. Since the procedures and practices do not comply with these constitutional requirements, the current appointment mode of the Federal Constitutional Court is regarded as unconstitutional.
