The outstanding constitutional theoretical positions of Weimar constitutional law are still present in constitutional law under the Basic Law. Of particular importance are the relevant theories of Hans Kelsen, Carl Schmitt, Rudolf Smend, and Hermann Heller. The fact that these authors continue to have a significant impact today raises the question of whether their constitutional theoretical designs—overall or in part—can serve as a suitable interpretative framework for a well-founded understanding of the Basic Law. An attempt to answer this question is made here based on a constitutional theoretical comparison.
