With police-issued bans on residence to prevent crimes and eviction orders to combat domestic violence, intervention options have recently been introduced into state police laws that extend far beyond the traditional standard authority of exclusion orders, both in spatial and temporal terms. Police exclusion measures have thus increasingly come into the focus of legal discussions and are becoming a growing concern for lawmakers and courts. The author examines the constitutional and administrative law issues arising in connection with police exclusion measures. She outlines the constitutional standards and legal bases for exclusion orders, bans on residence, and eviction orders, and discusses these, particularly addressing the question of whether and to what extent regulation in police laws is necessary.
