The work examines whether and to what extent intra-group employee leasing is restricted following the implementation of the European Directive 2008/104/EC on temporary agency work and the enactment of the law amending the Employee Leasing Act - Prevention of Abuse of Employee Leasing in 2011. In cases of intra-group employee leasing, both the lender and the borrower are affiliated within a group; temporary agency workers are therefore dispatched from one group company to another. In extreme cases, this can lead to employees being centrally hired by a group company (so-called personnel management company) and then leased to the other group companies, which then require little to no personnel of their own. This work examines the legal permissibility of this concept.
